Also, I only have 256 Ram, will that cause me problems. I can open the .avi file in the CineMagic Assistant and it will play but when I go to burn that's when I get ablolutely no response when clicking on the file to add and just goes to black screen.

Get DirectX 9c here. (Click this link)
Go to Windows> My computer> Right Click to get properties> Select Hardware> Device Manager> click the plus next to display adapter. Post what you find there and someone will help you find the updates.
To get more information about your computer, go to Belarc Advisor and download/run that program. What is your CPU speed? Post the information you find there about your hardware and add it to your signature by going to MyControls at the top of this page. Look at what others post to get an example.
The 256 RAM will make it be slow but it should work. My old laptop will run the program; just not very fast.
Did you try setting your Video Wave or My DVD to run in software mode?

Intel 82810 and it said it could not find more up to date drivers.

So even installing the latest version of directx (which you should) isn't going to solve your problem (that chipset didn't work right even in version 7/7.5 of EMC). You'll have to get a video card that supports directx9 if you want to use any of the video related functions of the program.

Disable the onboard graphics at reboot (in BIOS) and then update the drivers after the system is running.
The Intel chipset you have on the motherboard has a very limited functionality and just can't cope.
Also, 800 MHz CPU is just about scraping in for operating the suite - rendering even with an updated video card will be extremely slow
