I ordered the disc rather used a download and found the installation unproblematic
however I cannot find the AV gadget. I found an HTML file but it is incomplete. Any ideas where the gadget has gone? Has roxio stopped including it?

It's no longer included in C2009.

In EMC 10 the Easy Audio Capture [EAC] was an application in XP but a gadget in Vista.
In EMC 11 [Creator 2009] EAC is an application in both operating systems.
It's still there, but not as a gadget, accessed through "Capture Audio from Sound Card".
