Have you updated to version 1.0.3? The problem with iMovie imports is fixed in that version. It is a free download from Roxio's software updates page. Simply replace the earlier version with the newest version.
As for refunds, that's different depending on the seller. If you bought directly from Roxio you need to contact their customer service.

Yes I am on teh current version ans it still doesd not work, I have registered my dismay with CS at Roxio

What happens when you try to send the video to iMovie at the end of the recording?

Nothing, at the end of the import it just sits there doing nothing. If I try to manually add the file to Imovie it is greyed out.

The conversion to the format that iMovie can read takes a long time and it also takes awhile for iMovie to import the video. Try a test with. say, a 2-minute recording so the wait isn't that long. It may be that you thought it was doing nothing but it was actually doing the re-encoding in the background.
The video file recorded by the Easy VHS to DVD device is in MPEG 2 format which iMovie cannot import. So it makes sense that you can't add it to iMovie directly. Roxio included a conversion feature that creates an additional MPEG 4 movie file which then is automatically imported to iMovie.
If you plan to use iMovie with most of the videos you want to capture then it probably makes more sense to get ElGato's video recorder. It records in a format that iMovie can read. However, that format doesn't work with video DVDs without re-encoding to MPEG 2.
If the only reason you're wanting to use iMovie is the cut out sections you don't want, you can use Toast to edit the captured video without bothering with iMovie or the iMovie export at all.
The Easy VHS to DVD for Mac is ideal for users who want to make DVDs from their videos. It isn't as good for use with iMovie as some other products that capture in MPEG 4 format, but it does work given enough time.
Of course you may be correct that it is doing nothing when you instruct it to convert and send the video to iMovie. I'll do some more tests, too, to see if I have any problems with it.
