I think the argument is whether YouTube should be legally responsible for the content people post. To keep the site clear of copyright material would need a large team of all-knowing moderators who could instantly identify every image ever copyrighted, and the terms of the copyright held, and whether any of them had been relaxed by the copyright holder. (Imagine the size of THAT database!!) Since YouTube and its staff are not "Omnipotent" (there's only one Being supposed to qualify for that) it's impossible for them to do what Viacom wants, and totally unreasonable for Viacom to sue them.
