Considering refund...can't accept license

I just bought Toast 8. I had to open the box and the disk sleeve to see the license agreement during installation. There is no reference to a license requirement or specifics of the license agreement on the outside of the box or in the manual.

 

I don't agree with the license restriction to install on only one computer (like many I have both a laptop and desktop which I never use concurrently, so I would not be violating any fair use provisions with installation on both). So I am looking into returning the software for a refund. My problem is that like most vendors, mine will not accept return of an open box of software.

 

My vendor's very reasonable response is that it is Roxio's decision to not include license information on the box, and to require that potential users open the box and disk sleeve before seeing the license. Therefore Roxio should be responsible for providing refunds to owners of opened boxes.

 

I have looked all over the Roxio site and can't find a way to get a refund. Any suggestions as to how I can approach this situation? Every other software I've used either has a copy of the license on the box, or in hardcopy form that is accessible without breaking the seal on the disk sleeve. And the vendor of those with internal licenses accepts returns and provides a refund for people who cannot accept the terms of a license agreement inside of the box.

Sounds to me like you can do whatever you please with your software. You purchased it, and Roxio won't take it back because it was sold through another vendor. They put in silly shrinkwrap license, and they won't honor the terms they wrote (they won't take it back if you don't agree.) Install it on as many machines as you'd like.

As I read the policy it is specific to items purchased directly from the Roxio web store and not to items purchased thru other retailers. Other notes in the discussion group seem to also interpret it as I have. Am I wrong? Can I return no questions asked even though it was purchased elsewhere?

 

 

I've heard if you call the support number and put up a fuss, they will refund you anyways.

I think the EULA for Roxio's products needs to be rewritten. It is common to license to a single user and allow the user to put a working copy on a second computer with the limitation that only one copy can be in use at a time. That's what Roxio's license should allow. What's amusing is that Roxio folks have advised people in the forums that the way to burn simultaneously to more than one drive is to make a duplicate copy of Toast, open both and assign one copy to each drive. That would appear to violate the license even though it is a recommended practice.

 

Personally, I have copied Toast and Popcorn to two computers without purchasing multiple licenses because I'm the only user.

 

Rather than get a refund I'd ask Roxio to officially allow you to install it on two machines for one user.
